Going back to the original post, I doubt Ben will willingly go to be judged this time. He loved Alex, but really wasn't attached to Jacob. I don't think he feels a huge sense of regret.
As for the temple, something huge is definitely waiting to be revealed there. We haven't seen it for all of these seasons, ever since it was mentioned in Season 3.

I also got the impression that Smokey was on NotLockes side, and if so, wouldn't care about Ben killing Jacob.

That's exactly what I was coming in to post. And if it's true, then not only will he not judge Ben harshly for being his pawn, TPTB probably wouldn't create the scene at all.

A good point. Good point. When it came down to it, Ben went to be judged by choice. So unless Smokey wants to judge him and hunts him down to do it, there's no reason Ben has to go be judged for killing Jacob. Which brings us back again to the idea that, if Smokey and MIB are one in the same, then Smokey wouldn't want to judge Ben for killing Jacob.

I was struck by the "Locke" comment to Ben while walking to the statue--Locke "appeared" to not know that Smokey had told Ben to do whatever Locke said.
Either Locke was being the true master of manipulation (which would be hugely ironic considering it's Ben being manipulated) during that scene, or Locke and Smokey aren't one and the same.
I lean towards the "not" since in some thread (you'll have to search) that discussed the carvings in the underground structure, the artist who was brought in to carve the props said that the Anubis figure was making an offering to Smokey. That implies that Anubis is subject to Smokey and not equal to Smokey.
We know Smokey, but the Anubis character hasn't been revealed. I think the MiB is Anubis figure in the carving. And since the MiB who spoke with Jacob on the beach is unimpressed with humanity, being Anubis might fit with the MiB's tone about our whole race. Anubis had lots of power, just like the MiB seems to have (in whatever form of impersonation he chooses to show himself as). That he has to obey Smokey (as shown in the carving) means he has "rules" he must follow and cannot do whatever he wants, whenever he wants, to whomever he wants, however he wants to do it--that's the point of showing Anubis bowing before Smokey in the carving.
So I think that if the MiB is Anubis, and Anubis is currently manifesting himself as Locke, then Locke is not Smokey.
I like that idea Pink. It really fits in with good vs. evil etc., and even a "garden of eden" type of story line, i.e. birthplace of humanity or center of the universe. I like Smokey and Anubis/MIB versus Jacob for unitary control over this special place, and the future of the universe. Weighty stuff.
